1. Purpose and scope
These general terms and conditions (the "Terms and Conditions for the Purchase of Goods") are intended to regulate the purchase by any natural or legal person ("Customers") of products sold by LAIETANA DE LLIBRETERIA, S.L. (hereinafter, “laie.es” or "Laietana" and including the domain "laie.cat") via this online store (the "Online Store" or the “Website”).
The following terms shall have the meanings described below:
• Customer: natural or legal person who purchases one or several Products.
• Contract: purchase agreement through which Customers purchase the products for sale on the laie.es website.
• LGDCU: Royal Legislative Decree 1/2007, approving the revised text of the General Law for the Defence of Consumers and Users and other complementary laws.
• LSSI: Law 34/2002 on Information Society and Electronic Commerce Services.
• Products: items for sale in the Online Store of the laie.es website.
• User: natural or legal person who has created a user account in laie.es and may therefore enter restricted areas of the Website.
2. Obligations of Customers. User Registration
You must be registered as a User to perform any of the following actions:
• Buy products.
• Check the status of pending orders.
• Check or modify the personal data associated with your User account.
• Create and manage a list of favourites.
• Subscribe to information messages and other commercial notifications sent electronically.
All the details you include in the registration form shall be presumed to be accurate and truthful.
3. Purchasing process
The purchasing process is available in Catalan, Spanish and English, at the Customer's discretion. To make a purchase, you must be of legal age and registered as a User (see previous point).
The purchase of Products for sale on the laie.es website is subject to stock availability. We are unable to provide more precise information about the availability of a Product beyond the details which appear on the information page of each one or in other sections of the Web.If for any reason it is not possible to replace or otherwise solve the possible unavailability of any of the Products purchased by the Customer, the order shall be cancelled and the amounts paid shall be refunded in the shortest possible time.
The prices applicable to the Products are those indicated on our Website on the date of the order and include VAT (Value Added Tax).
The price of the Products is subject to changes by the Publisher and, in the case of imported books, to fluctuations in the currency of origin.
For orders placed from countries outside the European Union, Vat Added Tax (VAT) must be deducted from the total amount of the order; that is to say, 4% for the books and 21% for other objects and audiovisual materials.
Your User registration data shall be taken into account when entering into the Contract. Any mistakes made when registering your personal data must be corrected in the User profile before confirming the purchase. If you detect any mistakes after entering into the Contract, please contact laie.es immediately to report said incident.
Unless proven otherwise, the details and express acceptance registered on laie.es are proof of the transactions performed between laie.es and its Customers.
Once you have located the book you are looking for, you have two possibilities: add it to the shopping cart, or add it to "my favourites" list. To add a book to the shopping cart, simply choose 'buy' from the list of results or from the book tab. You do not need to register as a customer until you decide to confirm the purchase. Neither do you need to reach the end of the purchase process every time you add a book. You can add books and confirm your purchase later (although always during the same session), accessing the basket from the cart icon in the main menu. You can modify the quantities by changing the figure in the corresponding box or by using the '+' and '-' buttons on both sides of the box. To delete a title press the paper bin icon.
3.2. My favourites list
The favourites list serves to store information about books that interest you but that, for some reason, you do not want to buy immediately. To open a favourites list it is imperative that you register as a customer. Then you can check the favourites list every time you enter laie.es and identify yourself, accessing from "favourites list", in the main menu. To add a product to your wish list, choose 'add to favourites' from the list of results or from the product file. It is possible to buy from the favourites list by checking the box and then pressing 'add to the shopping cart'.
4. Acknowledgement of receipt
Once the Contract has been confirmed, you will receive an acknowledgement of receipt within 24 hours of confirmation, detailing the purchase information.
Orders may be collected from from any of our stores, within the established time, provided that confirmation has been received that it is available at the store selected. This must be indicated in the order form.
In-store collection is available within approximately 4 working days of your order. This is an estimated time frame, although we will do our utmost to ensure the prompt collection of Products.
In the case of deliveries, the delivery costs will be added to the total price of the order. If you have ordered several products, we will try to group them in a single delivery whenever possible to reduce Customer expenses, provided this does not delay the delivery too much.
The delivery cost will be calculated according to the following table (see table). The website shall calculate the final delivery cost, which shall be shown to the Customer prior to accepting the order and included in the invoice issued by laie.es.
For deliveries to non-EU countries, laie.es will not be responsible for any applicable taxes, customs duties, or other charges.
Products in stock shall arrive at the address indicated by the Customer within approximately 5 working days for deliveries to Spain and Portugal and approximately 15 working days for deliveries to other addresses. These are estimated time frames, although we will do our utmost to ensure the prompt delivery of Products.
If you select the “collect” option, payment will be made at the collection point, at the time of collection.
In the case of deliveries, Customers may pay for the Product with Credit card : Visa (Visa Electron not accepted) or MasterCard.
Laie.es will send the corresponding invoice to the Customer with the order. Credit cards will be charged when the product is shipped.
8. Security and confidentiality
Laie.es, however, does not guarantee uninterrupted access to the Website and is not liable for any damages arising from outages affecting their data processing centre, telephone lines, communications networks or electronic systems. Laie.es shall not be liable for any damages caused by any illegitimate third-party interference beyond their control.
Neither can they guarantee that the software on which Website operation depends is free of errors, computer viruses or other executable programs which could damage the computer systems of Website Users.
9. How to check the status of an order
You may check the status of your pending orders from the area reserved for Users, which shall correspond to one of the elements of the following table:
• in process: we have received your order form and we will contact you soon.
• available: we have received the Product you ordered. If you checked the “collect in Laie Librería Café” option, you can now collect it. If you chose to collect at another store, please wait for the order to appear as “received”.
• delayed: we cannot deliver the order within the expected time period, but we will let you know when product is available.
• available soon: you have ordered a Product that is not yet for sale. We will notify you as soon as we receive it.
• cancelled: we’re sorry, but we will not be able to fulfil your order.
• received: we have sent your order to the store where you will be able to pick it up, if you marked "collection at... [one of the indicated stores]" in the order form.
• sent: we have sent your order to the address you provided.
10. Right of withdrawal
Customers are entitled to withdraw from their respective Contracts within 14 calendar days without having to provide a reason. This period shall start on the day on which the Customer (or a third party appointed by them and other than the courier) purchases the Products. To make sure you are complying with the withdrawal period, you simply have to make known your intention to exercise your right to withdrawal before the end of the said period.
To exercise the right of withdrawal, you must notify us of your decision to withdraw from the Contract by means of an unequivocal statement (for example, a letter sent by post or email) to one of the following addresses:

For the purpose of providing a better service and ensuring internal control of returns, please include the following details about the order on which you wish to exercise your rights: order and/or invoice number, date when order was placed, date when order was received, and brief description of the Products. You may use the following form for this purpose, but it is not obligatory.
11. Consequences of withdrawal
If you withdraw from this Contract, we shall reimburse all payments received from you, including delivery costs (except any additional costs if you chose any delivery option apart from the cheapest one), without undue delay, no later than 14 days from the day on which we were informed about your decision to withdraw from this Contract. We will reimburse you using the same payment method you used for the initial transaction, unless you have expressly instructed otherwise. In any case, you will not incur any fees as a result of the reimbursement. We may retain the refund until we have received the Products, or until you have submitted proof that the Products have been returned, depending on which condition is met first.

You must return the Products without undue delay, and no later than 14 calendar days from the date you inform us of your decision to withdraw from the Contract. The terms of this agreement shall be met if you return the goods before said period has expired.
We also inform you that, as established in article 108.1 LGDCU, when the withdrawal is exercised, the Buyer will only bear the direct expenses of the return of the Product. Otherwise, the Customer shall only be liable for any diminished value of the Products resulting from handling of the goods beyond what is necessary to establish the nature, characteristics and function of the Product.
All Products sold via our Website are subject to a two-year (2) sales guarantee, in the terms established by the LGDCU.
Consequently, the Customer is entitled to claim for any defect which may exist upon delivery of the Products. The Customer may choose between having the Product repaired or replaced , unless one of these two options is objectively impossible or disproportionate. In addition, the Customer may not demand replacement in the case of non-replaceable Products.
In cases where repair or replacement have not been carried out within a reasonable time, or are not enforceable, the Customer shall be entitled to a price reduction or termination of the Contract.
Unless proven otherwise, it is presumed that any defects occurring six months (6) or more after delivery of the Product already existed at the time of said delivery, except for when this presumption is inconsistent with the type of Product or type of defect. If the defect manifests itself after the initial six months, the Customer shall have to prove that the defect already existed at origin and, therefore, that the Product should be covered by the guarantee.
Laietana shall be informed about any defect within two (2) months of it coming to the Customer's attention. The Customer shall be liable for damages and losses resulting from a delay in reporting said defect.
Exercising the rights described in this clause shall require the purchase invoice being sent to Laietana.
13. Customer service and complaints

In order to process your complaint or claim, please provide us with your full name, ID number, email and contact telephone number, as well as a description of the grounds for the complaint or claim. After receiving your complaint or suggestion, our Customer Service Department will proceed to send you a confirmation email with an incident number within 48 hours. Our staff will contact you via the email address or telephone number you have given to us in order to solve the problem.
14. Intellectual and industry property
All website content, including but not limited to texts, images, designs, products, software, trademarks and logos, is the property of Laie.es or, where appropriate, third parties with signed licensing agreements, and is protected by intellectual and industrial property rights.
Any exploitation of said content, and in particular the reproduction, distribution, disclosure and/or transformation thereof, is strictly prohibited without the prior written authorisation of the corresponding rights holder.Website content is publicly available solely for information purposes and may be modified and updated at any time.
The Website may contain links to other websites through hyperlinks, banners, etc., the management of which corresponds to third parties. In this sense, Laietana doesn’t accept any liability derived from any aspect relating to third-party websites to which a link is provided from the Website.
Laie.es reserves the right to take any action may deem appropriate against anyone who infringes any of the rights described in this section.
15. Applicable jurisdiction
In the event that any conflict or dispute should arise in the interpretation or application of these Terms and Conditions of the Purchase of Goods, the Courts and Tribunals that shall rule on the matter, if applicable, shall be those appointed by applicable legal regulations on competent jurisdiction, which address, in the case of final consumers, the place of fulfilment of the obligation or the domicile of the purchasing party.
In any case, the Customer will have every right to make an appeal before the Consumer Arbitration Board.
In the case of a purchase or sale made by a company that does not have consumer status under LGDCU, both parties shall be subject to the Courts and Tribunals of Barcelona (Spain), expressly waiving any other jurisdiction.
16. Changes to the Terms and Conditions of the Purchase of Goods
We reserve the right to modify at any time our Website and the corresponding policies, including these Terms and Conditions of the Purchase of Goods. Contracts shall be subject to the terms and conditions, policies and Terms and Conditions of the Purchase of Goods in force at the time you place your order. If any of these Terms and Conditions of the Purchase of Goods were to be rendered invalid, null and void or ineffective, said term or condition shall be deemed excluded from the Contract without affecting the remaining terms and conditions.
